Terms and Conditions - Happy New Year R1000

  1. The Brand Surgeon Competition (‘the Competition’) will be conducted by Brand Surgeon in South Africa from 21 January 2015 to 23 January 2015 (‘the Competition Period’). The winners will be announced on the 23 January 2015.
  2. The Competition is open to everyone living in South Africa. In addition to be eligible to participate you must be at least 13 (thirteen) years of age.
  3. Persons enter the Competition by registering on the website and updating their profile. A person is able to enter the competition once by updating their profile over the campaign period and only win once over the Competition period. (additional entries are from getting others to sign up / like Facebook Page 'TheBrandSurgeonSA' / follow Twitter Page '@thebrandsurge')
    1. As a participant you are able to share the competition via our Share Page (A) A Brand Surgeon email to an email address, (B) Posting on any social network or (C) Using the Link/QR Code Generator. Each verified share and associated new registration will qualify the participant an additional entry into the draw.
    2. Each type of share has a different entry value, (A) Sharing via Brand Surgeon email address adds 1 extra entry, (B) Sharing via any social network adds 1 extra entries and (C) Sharing via the Link/QR Code will add 1 extra entries. However, the person shared with MUST complete the Profile me or “like” the Facebook page in order for you to receive the entry to the competition.
  4. By entering the Competition you agree to be bound by these Terms and Conditions, which will be interpreted by The Brand Surgeon in its sole discretion. All decisions taken by The Brand Surgeon and their suppliers in the course of the Competition or any dispute are final and binding. Any breach of the Terms and Conditions may, at The Brand Surgeon's absolute discretion, result in forfeiture of any Prize.
  5. The judges’ decision is final and no correspondence will be entered into.
  6. The Brand Surgeon accepts no responsibility for entries lost, misdirected, illegible, late or altered.
  7. The Prize value is non-negotiable and is non-transferable and may not be exchanged for cash.
  8. The overall closing date is 23 January 2015 and no late entries will be accepted.
  9. The Brand Surgeon will conduct a draw from all the entries received during the Competition Period at the end of the Competition Period.
  10. Persons entering stand a chance to win 1 prize. A potential winner must provide addme@thebrandsurgeon.com with their personal and delivery details. In order to accept the Prize the above information must be provided within 7 days from the date that he/ she becomes aware that he/ she has become a potential winner.
  11. In the event that the potential winner cannot be contacted on their cell phone number or email after the close of the competition or do not accept delivery he/ she shall be deemed to have forfeited and have no claim against The Brand Surgeon arising therefrom. In this case, The Brand Surgeon will, at their sole discretion, reserve the right to reallocate the Prize to the next drawn valid entry or to declare the Prize forfeit.
  12. Any costs and expenses associated with Prize acceptance and use not specified herein as being provided is the winners’ sole responsibility, including any and all state and local taxes.
  13. As part of the Competition the winner will be required to be photographed or provide a photo, and to write a post (at no fee). By entering this Competition you agree that The Brand Surgeon may make media announcements and/or publications of the winner(s) and use these photos and posts for promoting the Competition and The Brand Surgeon in the digital, print and social media space.
  14. Any personal information relating to a participant that was collected by The Brand Surgeon during the Competition will not be shared with any third party without the participant’s express written consent.
  15. By entering this Competition you agree that The Brand Surgeon may communicate with you from time to time at The Brand Surgeon's discretion from which you can opt out at any time.
  16. You agree that The Brand Surgeon and its subsidiaries, as well as their or their subsidiaries’ advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever to the fullest extent permitted by law, and will be held harmless by winner(s) for any injuries, losses or costs or damage of any kind resulting in whole or in part, directly or indirectly from acceptance, possession, misuse or use of the Prize or parts thereof, or from participation in this Competition.
  17. The Brand Surgeon's entire liability and your sole and exclusive remedy will be limited to a distribution of the equivalent amount of Prize as set forth above. By participating in the Promotion, you waive any and all rights to bring any claim or action related to such matters in any forum beyond one (1) month after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
  18. To the maximum extent permitted by applicable law, The Brand Surgeon reserves the right to reduce the duration of, extend, modify or cancel the Competition. South Africa law applies to the operation of the Competition.
